Information on the Right of Withdrawal

Annex No. 3 to the Electric Bicycle Rental Agreement

This applies to a Lessee who is a consumer and to a natural person concluding the Agreement directly related to their business activity, where the Agreement is not of a professional nature for that person.

Right of withdrawal

You have the right to withdraw from the Agreement within 14 days without giving any reason. The withdrawal period expires 14 days after the day the Agreement was concluded.

To exercise the right of withdrawal, you must inform the Lessor (Spinly – Yaroslav Bulba, correspondence address stated at the beginning of the Agreement, e-mail: info@spinly.rent) of your decision to withdraw from the Agreement by an unequivocal statement (for example, a letter sent by post or by e-mail). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from the Agreement, we will reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we were informed of your decision to withdraw from the Agreement. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested the rental to begin during the withdrawal period, you will pay an amount proportionate to the period of actual use of the bicycle until the moment you informed us of your withdrawal from the Agreement, calculated according to the daily rate referred to in § 3(1) of the Agreement. This amount will be deducted from the payments being reimbursed.

The bicycle and its accessories must be returned without delay, no later than the day after the withdrawal statement is made, at the address indicated in § 3(10) of the Agreement. The deposit will be settled in accordance with § 5 of the Agreement.

How to withdraw

Under § 7(3) of the Agreement, withdrawal is made by an unequivocal statement, in particular one sent by e-mail to info@spinly.rent. It is enough to send such a statement to that address – using the model form below is not obligatory.

The deadline is met if the withdrawal statement is sent before 14 days have passed from the day the Agreement was concluded.
